Queens DUI / DWI Defense Lawyer

Most states call drunk driving DUI, which stands for driving under the influence.  In New York, it is called DWI, or driving while intoxicated.  There is also a related though lesser offense called DWAI, which stands for driving while ability-impaired.

NY Penalties for First-Offense DWI (Driving While Intoxicated), Aggravated DUI, and DWAI

In some states, DUI or DWI is treated as a traffic violation.  In New York, DWI is a crime, which means you will receive a record if you are convicted of intoxicated driving.  Though frequently charged as a misdemeanor, DWI can be elevated to a felony, which has more serious consequences, if certain factors were present.

Under NY Vehicle and Traffic Law § 1193(1)(b)(i), the following offenses are misdemeanors:

  • DWI
  • DWI (Per Se)
  • DWAI (Drugs)
  • DWAI (Combination)

The penalties for these offenses are provided by the statute, and include:

  • Up to 1 year in jail
  • A fine of up to $1,000 (plus additional surcharges)

Additionally, you will temporarily lose your driving privileges.  Your license will be revoked or suspended for at least six months if you are convicted of a first-offense DWI, DWAI with drugs, or combination DWAI.  Furthermore, you may be placed on probation for up to three years.

Aggravated DWI is also a misdemeanor.  Drunk driving or drugged driving is an aggravated offense when the person:

  • Had a high blood alcohol content (BAC), meaning 0.18% or higher
  • Had a passenger aged 15 or younger (“Leandra’s Law”)

The penalties for a first-offense aggravated DWI include:

  • Up to 1 year in jail
  • A fine ranging from $1,000 to $2,500
  • Driver’s license revoked for 1 year or more

The penalties for a first-offense DWAI with alcohol are less severe, though still serious, than the penalties for drug or combination DWAI.  Potential penalties for a first-time DWAI conviction in New York City include:

  • Up to 15 days in jail
  • A fine ranging from $300 to $500
  • Driver’s license suspended for 90 days

Unlike driving while intoxicated, driving while ability-impaired by alcohol is not a misdemeanor, but a lesser offense called a “violation.”  However, it will still be marked on your record.

Prison and Fines for Multiple DUIs (Driving Under the Influence) in Queens

The criminal penalties for a second or subsequent DWI, DWAI, or aggravated DWI are much harsher than the penalties for a first-time offense.  While a first-offense DUI is generally a misdemeanor in Queens, intoxicated driving becomes a felony if there are repeat instances.  The penalties for multiple offenses are listed below.

  • Second Offense DWI, DWAI (Drugs), or DWAI (Combination)
    • Class – Class E Felony
    • Fine – $1,000 to $5,000
    • Sentence – Up to 4 years in prison
    • License – Revoked for at least 1 year
  • Second Offense Aggravated DWI
    • Class – Class E Felony
    • Fine – $1,000 to $5,000
    • Sentence – Up to 4 years in prison
    • License – Revoked for at least 18 months
  • Third Offense DWI, DWAI (Drugs), or DWAI (Combination)
    • Class – Class D Felony
    • Fine – $2,000 to $10,000
    • Sentence – Up to 7 years in prison
    • License – Revoked for at least 1 year
  • Third Offense Aggravated DWI
    • Class – Class D Felony
    • Fine – $2,000 to $10,000
    • Sentence – Up to 7 years in prison
    • License – Revoked for at least 18 months
