How Do Bail Bonds Work in New York?

Not everyone in jail is there to serve time.  Many “prisoners” of New York’s county jails and correctional facilities are actually pretrial detainees, or suspects who are being held in custody while awaiting trial.  In many cases, it is possible to have a pretrial detainee released from jail by making a payment called bail.

Bail can be quite expensive, often costing thousands of dollars, particularly if the defendant has a prior criminal record.  However, if the alleged offense is “bondable,” you can use a bail bond, which will allow you to pay much less up front – only about 10% of the full bail cost.  For example, if the actual bail was $2,000, you would only have to pay about $200.

Bonds can make posting bail fast and simple, but they can also be somewhat risky from a financial standpoint.  If your loved one fails to appear in court after being released, which is colloquially known as “bail jumping,” the bail bond company can come after you for the full amount.  And bail jumping is more than just expensive – it’s a crime, meaning your loved one could be subject to additional fines and imprisonment.  Additionally, the fee you pay the bond company is nonrefundable, whereas cash bail you pay yourself would eventually be refunded if the defendant was acquitted and made all court appearances.
